   1.3 MATERIAL NOT CLAIMED AS COPYRIGHT-PROTECTED MERELY BY APPEARING ON THE WEBSITE

THINHNAM™ does not claim copyright ownership merely because information appears on its Website.

Unless protectable through a particular original expression, selection, arrangement, compilation, or other legally protected element, this Policy does not claim exclusive copyright in:

THINHNAM™ does not control their copyright review processes and does not guarantee that any complaint submitted to a third-party platform will result in removal, restriction, suspension, or other action.

2.7 ENFORCEMENT

THINHNAM™ may investigate suspected violations, preserve evidence, restrict access where technically and legally appropriate, request voluntary removal, submit platform reports, or pursue remedies available under applicable law.

2.8 CHANGES

THINHNAM™ may update these Terms when necessary. The current published version applies from its stated effective or updated date.

3.1 PURPOSE

- Facebook
- Telegram
- TikTok
- Instagram

- Discord

- Mobile applications
- Other online platforms or digital services

3.5 RE-UPLOADING AND REDISTRIBUTION

Users may not make unauthorized copies of protected THINHNAM™ original works and re-upload, republish, redistribute, sell, sublicense, or otherwise make those copies available through another service where such conduct infringes applicable rights.

3.6 MANUAL REPRODUCTION OR RECREATION

Unauthorized copying is not limited to screen recording.

A third party may reproduce protected expression by manually recreating or copying it. Examples may include:

- Redrawing an original THINHNAM™ graphic
- Recreating an original illustration
- Reproducing a substantial amount of original written expression
- Recreating protected visual presentation or artwork
- Copying original images or frames into a newly designed graphic
- Reproducing protectable creative elements in a new video or livestream
- Rearranging copied protected material into another publication

Whether a manually recreated work infringes copyright depends on the protected elements actually copied, the amount and substantiality of the copying, applicable exceptions, and applicable law.

 

3.7 FACTS, NUMBERS, DATA, AND INFORMATION

Users should distinguish protected creative expression from facts and information.

THINHNAM™ does not assert that a person infringes copyright merely because the person independently states the same:

- Number
- Result
- Date
- Public information
- Official information
- Raw data
- Idea or concept

However, a person may not assume that the original creative way THINHNAM™ expresses, illustrates, displays, arranges, or presents information is free to copy.

Where a complaint concerns manually retyped or recreated content, THINHNAM™ will assess whether protected expression or another legally protectable element has actually been copied before submitting a copyright complaint.

 

3.8 ADAPTATION AND DERIVATIVE WORKS

Where applicable copyright law grants the copyright owner relevant exclusive rights, unauthorized adaptation or creation of derivative works based on protected THINHNAM™ expression may be prohibited.

This provision does not prohibit uses that are authorized by law, license, permission, or an applicable copyright exception.

3.9 COMMERCIAL AND MONETIZED USE

 

Commercial or monetized use does not automatically determine whether copyright infringement exists. However, unauthorized commercial exploitation of protected THINHNAM™ works may be considered in determining and enforcing THINHNAM™ rights.

4. COPYRIGHT COMPLAINT

4.1 PURPOSE

Before submitting a copyright removal request, THINHNAM™ should reasonably verify:

1. The original work can be identified.
2. THINHNAM™ owns or is authorized to enforce the relevant rights.

4. The allegedly copied material is copyright-protected or otherwise subject to a legitimate copyright basis.

5. There is a reasonable basis to believe protected material was copied or used without authorization.

4.4 ORIGINAL WORK IDENTIFICATION

For each complaint, THINHNAM™ should preserve or provide, as applicable:

- Creation date, if available
- Original file or source material
- Author or creator, where relevant
- Copyright owner
- Basis of THINHNAM™ ownership or authorization
- Screenshots or archived evidence
- Other ownership documentation where necessary

4.5 IDENTIFICATION OF INFRINGING CONTENT

THINHNAM™ should identify the exact content being reported.

Where possible, preserve the direct URL to the specific:

- YouTube video, Short, livestream, or other content
- Facebook video, post, Reel, livestream, or other content
- Telegram public post or other reportable public content
- Website page
- Image
- Video
- Other digital publication

A profile, channel, page, or homepage URL may be preserved as supporting context, but a direct content URL should be used when the relevant platform requires or supports it.

4.6 DESCRIPTION OF INFRINGEMENT

 

The complaint should explain clearly:

- What THINHNAM™ original work is protected
- What portion of that work was allegedly copied
- Where the copied material appears in the reported content
- How the reported use reproduces or uses protected expression
- Whether the use is a screen recording, screenshot, re-upload, livestream, reproduction, recreation, adaptation, or other form of use
- Why THINHNAM™ believes the use is unauthorized
- Any relevant timestamps for video or livestream content

4.7 COMMON INFRINGEMENT CATEGORIES

A. DIRECT SCREEN RECORDING
The reported content directly records protected THINHNAM™ Website material and republishes or broadcasts the recording.

B. SCREENSHOT OR IMAGE COPYING
The reported content reproduces original THINHNAM™ images, graphics, illustrations, or other protected visual material.

C. RE-UPLOAD
The reported party uploads an unauthorized copy of a THINHNAM™ original video, image, animation, or other protected work.

D. LIVESTREAM OR REBROADCAST
The reported party displays or broadcasts protected THINHNAM™ original content through a livestream or rebroadcast.

E. MANUAL REPRODUCTION
The reported party manually recreates protected THINHNAM™ expression rather than directly recording it.

F. ADAPTATION OR DERIVATIVE USE
The reported party modifies protected THINHNAM™ expression while retaining protectable copied elements.

G. FACT-ONLY OR RAW-DATA USE
If the reported content uses only facts, numbers, raw data, public information, ideas, or other unprotected material without copying protectable THINHNAM™ expression, THINHNAM™ should not characterize the use as copyright infringement solely because the information originated from the Website.

4.8 EVIDENCE PACKAGE

For significant complaints, THINHNAM™ should maintain an evidence package containing, where available:

- Original work
- Original URL
- Original publication date
- Original source file
- Infringing URL
- Date infringement was discovered
- Screenshot of infringing content
- Archived copy or recording where lawful
- Side-by-side comparison
- Relevant video timestamps
- Ownership documentation

- Previous correspondence
- Platform complaint reference number

4.9 PLATFORM-SPECIFIC SUBMISSION

Copyright complaints submitted to YouTube, Google, Meta/Facebook, Telegram, or another service must follow that service's current copyright reporting process.

THINHNAM™ recognizes that:

- A Website policy does not compel a third-party platform to remove content.
- Each platform independently evaluates complaints.
- A platform may request additional evidence or clarification.
- A platform may reject an incomplete or unsupported complaint.
- A platform may provide an uploader with an appeal, dispute, or counter-notification process.
- Platform procedures may change over time.

4.10 YOUTUBE AND GOOGLE

For YouTube or Google copyright removal requests, THINHNAM™ should use the applicable official copyright/legal reporting process and provide the specific content URL, a clear identification of the copyrighted work, the required claimant information and declarations, and any other information requested by the official form.

A YouTube copyright removal request is a legal process and is distinct from a Content ID claim.

THINHNAM™ must not represent that it has Content ID access unless such access has actually been granted by YouTube.

 

4.11 META/FACEBOOK AND OTHER SOCIAL PLATFORMS

For Meta/Facebook or other social platforms, THINHNAM™ should use the platform's official intellectual property or copyright reporting procedure and provide the information required by that platform.

The scope and outcome of a complaint depend on the platform's current procedures and applicable law.

4.12 TELEGRAM

Where Telegram provides a copyright complaint procedure for the relevant type of public content, THINHNAM™ should follow Telegram's current official process and provide the information requested.

THINHNAM™ should not assume that all private or public Telegram content is subject to identical copyright reporting procedures.

4.13 GOOD-FAITH AND ACCURACY DECLARATIONS

Where required by the receiving platform or applicable law, the claimant must provide the platform's required good-faith, accuracy, authority, penalty-of-perjury, or equivalent declarations.

THINHNAM™ should use the exact declarations required by the relevant platform at the time of submission rather than relying on this Policy as a substitute for the platform's legal form.

4.14 SIGNATURE AND CLAIMANT INFORMATION

Where required, THINHNAM™ must provide the legal name and valid electronic or physical signature of the copyright owner or authorized representative and any required contact information.

A company name should not be substituted for a person's legal signature where the platform requires the full legal name of the individual signing the notice.

4.15 COUNTER-NOTIFICATIONS, APPEALS, AND RETRACTIONS

An uploader or platform user may challenge a copyright removal through an available appeal, dispute, or counter-notification procedure.
